1. Scope

These terms and conditions apply to all offers, services, and contracts between Mario Rainer (hereinafter “Contractor”) and his business clients (hereinafter “Client”), unless otherwise agreed in writing.
 

2. Services

The Contractor provides 3D renderings, animations, layouts, and websites according to individual agreements.
Work is usually based on client-provided data, such as CAD files.
The exact scope, delivery dates, and pricing are confirmed in writing or by email.

Revisions: One revision round for minor adjustments is included. Additional revisions are charged at €95 net per hour. Extensive changes may require a new calculation, which will be discussed in advance.

Additional Costs: Any potential license fees, material costs, or external services will be communicated in advance and invoiced separately.
 

3. Usage Rights

The Client receives a non-exclusive license to use the delivered renderings and animations after full payment.
All created files and designs remain the property of the Contractor until payment has been received in full.
Any redistribution or third-party use requires the explicit consent of the Contractor.
The Contractor reserves the right to use the works for self-promotion (e.g., on the website or portfolio), unless a separate confidentiality agreement (NDA) is signed.
 

4. Free Test Rendering (“Let’s Collab”)

As part of “Let’s Collab,” the Contractor offers potential clients a free rendering under the conditions described on the website.
By using this offer, the Client agrees that the created renderings are only for the agreed purpose.
Any additional usage rights require a separate agreement.
 

5. Confidentiality

All provided data, especially CAD files and project details, will be treated strictly confidential.
Upon request, the Contractor will sign a separate NDA (Non-Disclosure Agreement).
 

6. Pricing & Payment

Payment Models: Projects may be billed as a fixed price or, for larger assignments such as animations, according to an hourly rate of €95 net. The model will be agreed upon before project start.

Payment Terms: In accordance with § 6 Abs. 1 Z 27 UStG (Austria), no VAT is charged (small business regulation). Invoices are payable in full within 14 days of issue without deduction.

Late Payment: A reminder fee of €29 will be charged in case of overdue payment. If payment is not received within 14 days after the reminder, the Contractor reserves the right to take legal action.

Cancellation: If a project is canceled by the Client after more than 50% of the work has been completed, the full project amount becomes due. This includes rendering times and partial services already provided.
 

7. Liability

The Contractor is liable only for intentional or grossly negligent actions.
No liability is assumed for errors resulting from faulty or incomplete data provided by the Client.

8. Governing Law & Jurisdiction

Austrian law applies.
The place of jurisdiction is Linz, Austria, insofar as legally permissible.

If any provision of these Terms & Conditions is invalid, the validity of the remaining provisions remains unaffected.
